29 CFR 1910.146(c)(4):When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: (a) PRODUCTION FLOOR, WELD AREA - The employer assigned welders to complete welding tasks in areas that were identified as permit required confined spaces, and the employer had not fully developed and implemented a written confined space entry program, on or about December 21, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.146(e)(1):Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit: (a) PRODUCTION WELD AREA - Employees performed welding, grinding and air-arcing activities inside the top portion of the Virginia Payload Tubes (VPT) which was an area that meets the criteria for a permit required confined space. The employer did not require the entrants to perform the work under the guidance of a permit that would have controlled hazards located within the space which included but were not limited to atmospheric hazards and fire hazards, on or about December 21, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146 (a) PRODUCTION WELD AREA - Employees performed welding, grinding and air-arcing activities inside multiple spaces that met the criteria for permit required confined spaces including, but not limited to the M290 casks and the top portion of the Virginia Payload Tubes (VPT). The employer did not provide effective training to all employees who perform work in permit required confined spaces necessary to maintain safe working conditions while working in the permit spaces, on or about December 21, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
