29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or caught-in between operating motor vehicles and equipment: a) 3899 Blk Governor Printz Blvd Wilmington, Delaware 19802 (South Bound Lanes): On or about January 13, 2022, employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed paving operations to facilitate a roadway repair without the use of a properly communicated internal traffic control plan. b) 3899 Blk Governor Printz Blvd Wilmington, Delaware 19802 (South Bound Lanes): On or about January 13, 2022, employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed paving operations to facilitate a roadway repair without the use of high visibility vests.

In the alternative: 29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition) a) 3899 Blk Governor Printz Blvd Wilmington, Delaware 19802: On or about January 13, 2022, employees were exposed to multiple hazards onsite including but not limited to struck by/ caught in hazards when they accessed or egressed the site and parked equipment and vehicles adjacent to work zone to perform site preparation work for road patching which required personnel and equipment to cross active roadway lanes without the use of traffic control measure to stop or slow traffic such as appropriate flaggers.

The Brandywine Construction Company, Inc. DBA BCCI was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1465419, citation number 1, item number 1 and was affirmed as a final order on 10/05/2020, with respect to a workplace located at Rt. 48 and Court Drive, Wilmington, DE 19805.
