29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   a) Facility wide - On or about February 24, 2022, the employer did not obtain the manufacturer's written approval prior to modifying the Toyota Sit Sown Forklifts by attaching the Cascade clamps.  The data plates on the Toyota forklifts 7, 9, and 11, were not marked to identify the attachments and did not show the capacity weight of the truck and attachment combination.  b) Facility wide - On or about August 10, 2022, the employer did not obtain the manufacturer's written approval prior to modifying the backup/reverse lights on the Toyota Sit Down Forklifts 7, 9, and 11.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) North end of building - On or about February 24, 2022, the employer did not ensure that guards or methods of guarding were adequate to protect employees from point of operation hazards, moving parts, and projectile debris from equipment, such as the Economy scrap pit baler. The guard door locking mechanism was misaligned and damaged allowing the guard door to open during operation.  No abatement certification or documentation is required for this item.
