29 CFR 1910.242(a): Hand and portable powered tools and equipment, general. General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. a) On or before 02/21/2022, the employer did not ensure that employees operating the Everwin Pneumatic Coil Nailer PN65, PN70 and/or PN80 to manufacture wooden pallets while employees held down the trigger when a stuck nail misfired into parts of their bodies such as but not limited to the left wrist. b) On or before 05/18/2022, the employer did not ensure that employees operating the Everwin Pneumatic Coil Nailer PN65, PN70 and/or PN80 were not administering constant pressure on the trigger for the nailer to prevent firing the nail guns nails from firing into parts of their bodies such as but not limited to the left wrist. c) On or before 05/24/2022, the employer did not ensure that employees operating the Everwin Pneumatic Coil Nailer PN65, PN70 and/or PN80 were properly placing the nail gun against the wood pallet prior to firing the nail gun to prevent firing the nail guns nails from firing into parts of their bodies such as but not limited to the left middle finger. d) On or before 06/06/2022, the employer did not ensure that employees operating the Everwin Pneumatic Coil Nailer PN65, PN70 and/or PN80 were not administering constant pressure on the trigger and placing portions of their bodies such as but not limited to (free hand) on the the wood during manufacturing exposing parts of their bodies such as but not limited to the left wrist to injury when the wood breaks where their free hand is located.

29 CFR 1910.243(d)(2)(i)(a): The muzzle end of the tool shall have a protective shield or guard at least 3 1/2 inches in diameter, mounted perpendicular to and concentric with the barrel, and designed to confine any flying fragments or particles that might otherwise create a hazard at the time of firing. a) On or about February 21, 2022, the employer did not ensure that the Everwin Pneumatic Coil Nailer PN65, PN70, PN80 used by employees to manufacture wooden pallets maintained the work piece contact attachment in place. b) On or about May 18, 2022, the employer did not ensure that the Everwin Pneumatic Coil Nailer PN65, PN70, PN80 used by employees to manufacture wooden pallets maintained the work piece contact attachment in place. c) On or about June 06, 2022, the employer did not ensure that the Everwin Pneumatic Coil Nailer PN65, PN70, PN80 used by employees to manufacture wooden pallets maintained the work piece contact attachment in place.

29 CFR 1910.243(d)(2)(i)(d)(2): Firing of the tool shall be dependent upon at least two separate and distinct operations of the operator, with the final firing movement being separate from the operation of bringing the tool into the firing position. a)On or about May 18, 2022, the employer did not ensure that the firing of the Everwin Pneumatic Coil Nailer PN65, PN70, PN80 require at least two separate and distinct operations of the operator in that employees were maintaining their fingers on the trigger for constant pressure and the work piece contact attachment was not present for at least one of the two separate and distinct operations. b) On or about June 06, 2022, the employer did not ensure that the firing of the Everwin Pneumatic Coil Nailer PN65, PN70, PN80 require at least two separate and distinct operations of the operator in that employees were maintaining their fingers on the trigger for constant pressure and the work piece contact attachment was not present for at least one of the two separate and distinct operations.
