29 CFR  1910.22(a)(3): Surface conditions. The employer must ensure: Walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice.  a) On May 16, 2022, the employer did not ensure walking-working surfaces such as but not limited to the protruding steel tram track measured at 28" in width and 1" in height was not maintained free of hazard in that in building #4 a Yale Veracitor 50VX Model: GPL050VXNESE084 Serial: D87513807U forklift truck hit the raised steel tram track with the forks.

The employer must ensure: Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition   a) On or about May 16, 2022, the employer did not ensure that walking-working surfaces such as but not limited to the steel tram track measured at 28" in width and 1" in height were inspected regularly and as necessary to ensure that when forklift operators cross the track they were not exposed to striking the 1" protrusion.

If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired  a) On or about May 16, 2022, the employer did not ensure that hazardous conditions on walking-working surfaces were corrected or repaired before employees use the walking-working surface again in that an employee struck the steel tram track in building #4 with the fork of a Yale Veracitor 50VX Model: GPL050VXNESE084 Serial: D87513807U  forklift truck after previous accidents had occurred involving the steel tram track.

29 CFR  1910.176(a):Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked.  a) On or about May 13, 2022, the employer did not ensure permanent aisles and passageways were appropriately marked in that in buildings such as but not limited to #1 and #4 where there were no designated permanent aisles or passageways.

29 CFR  1910.176(b):Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse.  a)  On or about May 12, 2022, the employer did not ensure that the bundles of 2x4 Prem Stud SPF stored in tiers located in the lumber yard was properly stacked in that the 3 bundles stacked and not interlocked in that each bundle's top layer is half the width of the total bundle and not interlocked with the bundle it is stacked on top of in that it had up to a 15 degree of deflection.  b)  On or about May 12, 2022, the employer did not ensure that the bundles of red  Randaply Pine Plywood stored in tiers located in building #4 was properly stacked in that they were stacked 20 feet 6 inches high to the ceiling, was inadequately interlocked, nor was it secured from sliding in the pedestrian walkways.

29 CFR  1910.219(f)(3):Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets.  a) On or about May 13, 2022, the employer did not ensure all sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform in that an employee was operating the Newman KM-16 without a waist-high chain enclosed.
