29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)DakotaView Construction, Inc. at 5313 Pine Ridge Drive in Sioux Falls, SD 57107: On or about and at times prior to March 15, 2022, the exposing employer did not ensure employees installing roof sheathing on a three-story apartment building were protected from fall hazards in that employees did not use fall protection when performing this work. This condition exposed employees to approximate 30-foot fall hazards.

29 CFR 1926.502(i)(3): All covers were not secured when installed so as to prevent accidental displacement by the wind, equipment, or employees: (a)DakotaView Construction, Inc. at 5313 Pine Ridge Drive in Sioux Falls, SD 57107: On or about and at times prior to March 15, 2022, the exposing employer did not ensure employees were protected from fall hazards when working near the third floor elevator shaft in that the lumber used a a cover over the elevator shaft was not effectively secured to prevent accidental displacement. This exposed employees to fall hazards of approximately nine feet.
