29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Dakota View Construction, LLC at 309 South Tumble Creek Avenue, Sioux Falls, SD 57110: On or about and at times prior to May 22, 2024, the employer did not ensure that an employee operating the Ingresoll-Rand, All-Terrain Forklift, Model VR-843C was competent to operate by ensuring the employee completed operator training, evaluation, and certification prior to use.  This condition exposed employees to struck-by and crushing hazards.

This condition exposed the employees to fall hazards greater than six feet.

This condition exposed the employees to fall hazards greater than six feet.  (b)DakotaView Construction LLC at 309 South Tumble Creek Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 22, 2024, the employer did not ensure that employees performing framing operations on the second floor of a residential property were protected from falls from a window to the lower level by an adequate fall protection system. This condition exposed the employees to fall hazards greater than six feet.  (c)DakotaView Construction LLC at 309 South Tumble Creek Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 22, 2024, the employer did not ensure that employees performing framing operations on the second floor of a residential property were protected from falls to the lower-level basement area by ensuring and adequate fall protection system was in place. This condition exposed the employees to fall hazards greater than six feet.  DakotaView Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1583652, citation number 1, item number 1, and was affirmed as a final order on September 6, 2022, with respect to a workplace located at 5313 Pine Ridge Drive, Sioux Falls, SD 57107.
