29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: (a)DakotaView Construction, LLC at 2451 Anamosa Street, Rapid City, SD 57701: On or about and at times prior to July 16, 2024, the exposing employer did not ensure a safe means of access was provided to an employee transitioning from the upper level door opening on the residential property to the platform of the pump jack scaffolding system to conduct residential construction activities. This condition exposed the employee to fall hazards.

29 CFR 1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. (a)DakotaView Construction, LLC at 2451 Anamosa Street, Rapid City, SD 57701: On or about and at times prior to July 16, 2024, the exposing employer did not ensure that each employee who performed work while on a scaffold system was trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. This condition exposed the employees to collapse, access, fall, electrical, and struck-by scaffolding hazards.

This condition exposed employees to fall hazards greater than six feet.

This condition exposed employees to fall hazards greater than six feet.
