29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:    (a)DakotaView Construction, LLC at  2451 Anamosa Street, Rapid City, SD 57701: On or about and at times prior to July 16, 2024, the exposing employer did not ensure a safe means of access was provided to an employee transitioning from the upper level door opening on the residential property to the platform of the pump jack scaffolding system to conduct residential construction activities.  This condition exposed the employee to fall hazards.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  (a)DakotaView Construction, LLC at 2451 Anamosa Street, Rapid City, SD 57701: On or about and at times prior to July 16, 2024, the exposing employer did not ensure that each employee who performed work while on a scaffold system was trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  This condition exposed the employees to collapse, access, fall, electrical, and struck-by scaffolding hazards.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that employees could not free fall more than 6 feet nor contact any lower level:  (a)DakotaView Construction LLC at  2451 Anamosa Street, Rapid City, SD 57701: On or about and at times prior to July 16, 2024, the exposing employer did not ensure that employees were protected from fall hazards due to the fall protection system not being properly rigged to prevent a free fall of more than six feet while conducting residential construction activities on the platform of a pump jack scaffolding system.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.502(d)(15):Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person:  (a)DakotaView Construction LLC at  2451 Anamosa Street, Rapid City, SD 57701: On or about and at times prior to July 16, 2024, the exposing employer did not ensure that employees were protected from fall hazards due to the fall protection system not being properly rigged and anchored to an anchorage capable to support at least 5,000 pounds while the employee was conducting work on the pump jack scaffolding system.  This condition exposed employees to fall hazards greater than six feet.
