29 CFR 1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used: On or about March 30, 2022, employees working from the elevated work platforms located in the chemical basement were exposed to fall hazards of up to 9 feet and the employer had not ensured a self-closing gate was used at the top of the fixed ladder: a. used to access the electrical disconnects. b. used to access the fibrous coagulant tanks. c. used to access the coal filter. d. used to access the skinless NK glycerine tank. e. used to access the area under the skinless and next to the glycerine tank.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): On or about March 25, 2022, employees were exposed to entanglement hazards while greasing and oiling the roller bearings on PM Machine 7, PM Machine 2 and PM Machine 1, and the employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements}. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.
