29 CFR  1926.403(b)(2): Installation and use. Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification:   a- Foundry Boulevard, Mount. Holly NJ: On or about 04/12/22 a portable electric circular saw, in use by the company worksite Foreman, was powered with a flexible cord that had not been listed, labeled or certified.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:  a- Foundry Boulevard, Mount Holly NJ: On or about  04/12/22 a portable, electric, circular saw was observed being powered with a damaged flexible cord.  This damaged cord was missing its outer protective covering and exposed its inner wires to damage.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a- Foundry Boulevard, Mount Holly NJ: A worker was exposed to fall hazards, up to and in excess of 19 feet 8 inches to the ground surface below, when walking and working at the unprotected edges of unsecured floor trusses (set flat on the structure's second floor) without the use of fall protection.    Condition observed on or about 04/12/22.  b- Foundry Boulevard, Mount Holly NJ:  A worker was exposed to fall hazards, up to an in excess of 8 feet 10 inches to the floor below, when securing floor trusses onto a commercial structure's second floor wall top plates while walking and working from a different wall's top plates without the use of fall protection.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)    a- Foundry Boulevard, Mount Holly NJ:  A worker, not utilizing fall protection, was exposed to fall hazards (up to and in excess of 19 feet 8 inches to the ground surface below) when walking and working at and near the unprotected edges of a commercial structure's second floor and when walking from the top plates of an exterior wall.  This worker had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).  Condition noted on or about 04/12/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
