29 CFR 1926.451(b)(2)(ii): When walkways between scaffold sections are less than 18 inches wide, employees were not protected from falls by guardrail systems or personal fall arrest systems: a) Opening Leading to Basement, 2159 Sachs Avenue, Toms River NJ: An employee was hospitalized after falling off of a supported scaffold's walking/working surface that was not provided with the required fall protection by the employer. This scaffold's walking/working surface was approximately 15 inches wide. As such, this employee received injuries after falling in excess of 11 feet 6 inches onto the concrete floor below the supported scaffold. Condition noted on or about 04/14/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Majestic Builders NJ, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1541453, citation number 1, item number 2 and was affirmed as a final order on 01/11/22, with respect to a workplace located at 182 Plainfield Avenue, Berkeley Heights, NJ. This walking/working surface was accessed by the employee from a 4 foot by 8 foot piece of plywood that spanned the floor opening and was set, partially, over the walking/working surface. This single sheet of plywood was not supplied with the required fall protection and thus exposed the employee to fall hazards in excess of 13 feet 9 inches to the concrete covered floor below. Condition noted on or about 04/14/22. Majestic Builders NJ, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1541453, citation number 1, item number 3 and was affirmed as a final order on 01/11/22, with respect to a workplace located at 182 Plainfield Avenue, Berkeley Heights, NJ.
