29 CFR 1910.252(b)(3): Employees exposed to the hazards created by welding, cutting, or brazing operations were not protected by personal protective equipment in accordance with the requirements of 29 CFR 1910.132: Mixing Department, Mixer 22, Floor 1: On or about 9 April 2022, an employee welding on a Harburg-Freudenberger Maschinenbau GmbH serial number 01.1367 tandem mixer was not protected by suitable personal protective equipment. The employee wore a white DuPont Tyvek 400 disposable coverall over a flame resistant Aramark SteelGuard Essentials Cat 2 uniform.

29 CFR 1910.252(a)(2)(vi)(C): Cutting or welding was permitted in the presence of explosive atmospheres (mixture of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that could develop inside uncleaned or improperly prepared tanks or equipment which had previously contained such materials, or that could develop in areas with an accumulation of combustible dusts: Mixing Department, Mixer 22, Floor 1: On or about 9 April 2022, an employee welding the stuffer door on a Harburg-Freudenberger Maschinenbau GmbH serial number 01.1367 Tandem Mixer suffered burns to his arms and back when a flash fire occurred. The supervisor that approved the hot work permit in this location did not determine whether the presence of explosive atmospheres existed, or could develop prior to permitting the welding.
