29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: a) Bucyrus Railcar Repair, various areas throughout the facility, on or about January 21st, 2022 and times prior thereto: Employees performed work operations in confined spaces including, but not limited to, gondola style rail cars. An attendant with a preplanned rescue plan was not stationed outside of the confined spaces to observe employees conducting welding operations within the rail cars. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.151(b):There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid: a) Bucyrus Railcar Repair, various areas throughout the railyard, on or about January 21st, 2022 and times prior thereto: Response times for the arrival of emergency medical services at the facility for the treatment of life threatening injuries or illnesses which could potentially occur during confined space entries were unknown at the time of the inspection. The employer did not have designated personnel who were readily available to provide first aid at the site. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
