On or about April 21, 2022, the employer did not ensure that the outside shipping yard pothole that measured approximately 1 inch deep and 26 inches long was adequately inspected regularly and as necessary to maintain a safe condition for powered industrial vehicle operators operating in the shipping yard area. b.) On or about April 21, 2022, the employer did not ensure that the upper tarp lot pothole that measured approximately 4 inches deep and 38 inches wide x 60 inches long was adequately inspected regularly and as necessary to maintain a safe condition for powered industrial vehicle operators operating in the shipping yard area.

29 CFR 1910.22(d)(2): Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired; and a.) On or about March 10, 2022, hazardous conditions such as potholes located in the outside storage yard and upper tarp lot were not corrected or repaired prior to employees operating powered industrial vehicles over the potholes exposing employees to tip over conditions.

29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a.) On April 21, 2022, the aisles in the Outside Storage Yard were not in good repair in that, potholes created a hazard for powered industrial vehicles traveling with elevated loads on uneven ground surfaces. b.) On April 21, 2022, the passageways in the Upper Tarp Lot were not in good repair in that, potholes created a hazard for powered industrial vehicles loading flat bed semi-trucks with elevated loads on uneven ground surfaces.

29 CFR 1910.178(n)(7)(iii): On all grades the load and load engaging means shall be tilted back if applicable, and raised only as far as necessary to clear the road surface. a.) On or about April 21, 2022, the employer did not ensure that the load was raised only as far as necessary to clear the road surface in that the Linde forklifts carrying loads of composite decking approximately 16 ft. and/or 20 ft. at elevation where their loads were raised approximately 10 feet high while traveling through the outside storage yard to clear stacks of composite decking stored in the aisleways.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. a.) On or about April 21, 2022, Linde H40T forklift, L39 (SN# H2X394F01039), was not removed from service and operated in an un-safe condition, in that the mast bearing was going out and needed replaced. b.) On or about April 8, 2022, Linde H40T forklift, L16 (SN# H2X394G03212) , was not removed from service and operated in an un-safe condition, in that the forklift had an antifreeze leak.
