29 CFR  1910.132(d)(1):The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:   TARP Packaging Area: On or before May 5, 2022: Employees conducted binding and strapping operations with equipment that generated plastic bands in order to seal and/or reinforce a variety of packages, and were required to wear safety glasses in case plastic bands came undone abruptly. The Employer did not evaluate the tasks to have necessitated the use of safety glasses/goggles. Employees were exposed to temporary or permanent blindness, and/or retinal  damage.

29 CFR  1910.132(d)(2): The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:    (a)TARP Packaging Area: Employees, with various packaging tasks, conducted  binding, sealing, and strapping operation that generated heat and abrupt release of plastic bands if not attached properly. The employer did not verify that the workplace hazard assessment had been completed with a written certificate. Employees were exposed to dermal burns, retinal damage and/or blindness, crushing and/or entrapment hazards.   (b) Woodworking Area (Maintenance Shop): Employees conducted carpentry tasks such as grinding, drilling, and mechanical cutting that generated wood and metal dusts and were required to wear an 3M N95 respirator. The employer did not verify that the required workplace hazard assessment had been completed with a written certificate. The employees were exposed to hazards that could exacerbate underlying medical conditions or create upper respiratory irritation.

Warehouse Building 661: On May 5, 2022, The employer did not ensure  employees followed all traffic regulations in that when an operator restraint system such as a seat belt was not used during operation. Employees were exposed to ejection and crushing hazards.

29 CFR  1910.132(f)(2):The employer did not require employees to demonstrate an understanding of the training specified in paragraph (f)(1) of this section, and the ability to use PPE properly, before being allowed to perform work requiring the use of PPE.  TARP Packaging Area: Employees performed banding and strapping operation which applied plastic bands and heat to bind and reinforce boxes of various shape, size, and materials; as a result those produced loose plastic bands and heat from the surface. Employer did not require employees to wear personal protective equipment prior to performing the operations and did not provide sufficient training regarding the equipment employees operating. Employees were exposed to permanent blindness, crushing, entrapment and/or dermal burns.
