29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a- 61  Autumn Park Drive, Medford NJ: Two workers were exposed to fall hazards, up to and in excess of 21 feet 3 inches to the ground surface below when walking and working  at and near unprotected edges of a residential structure's third story floor without the use of fall protection while performing framing and other related activities.    Condition observed on or about 05/11/22.  b - 65 Autumn Park Drive, Medford NJ: One worker was exposed to fall hazards, up to and in excess of 21 feet 8 inches to the ground surface below, when walking and working at and near unprotected edges of a residential structure's third story floor without the use of fall protection while attempting to install guard rails.  Condition observed on or about 05/11/22.  c- 65 Autumn Park Drive, Medford NJ: One worker was exposed to fall hazards up to and in excess of 19 feet 6 inches when accessing and egressing a residential structure's third story floor to/from the unprotected interior stairway opening.  Condition observed on or about 05/11/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):   a- 61  Autumn Park Drive, Medford NJ: Two workers were exposed to fall hazards, up to and in excess of 21 feet 3 inches to the ground surface below when walking and working  at and near unprotected edges of a residential third story floor without the use of fall protection while performing framing and other related activities.    Condition observed on or about 05/11/22.  b - 65 Autumn Park Drive, Medford NJ: One worker was exposed to fall hazards, up to and in excess of 21 feet 8 inches to the ground surface below, when walking and working at and near unprotected edges of a residential structure's third story floor without the use of fall protection while attempting to install guard rails.  Condition observed on or about 05/11/22.  c- 65 Autumn Park Drive, Medford NJ: One worker was exposed to fall hazards up to and in excess of 19 feet 6 inches when accessing and egressing a residential structure's third story floor to/from the unprotected interior stairway opening. The workers involved in the instances above, along with the company worksite Foreman, had not received fall protection training from a competent person qualified in the areas specified in 29 CFR 1826.503(a)(2)(i) through (viii).  Condition noted on or about 05/11/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. Condition observed on or about 05/11/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
