29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:   a. On or about September 22, 2022, the employer failed to provide verification of enhanced abatement, Employee Fall Protection Training, as listed in Line-Item Number 9, of the Informal Settlement Agreement, for inspection 1598850, which was signed by the employer on August 29, 2022, with an abatement due date of September 22, 2022.

On a new residence, located at 357 Brookgreen way, lot 808, Saint Augustine, FL: On or about May 23, 2022 and at times prior, the employer exposed employees to hazards common to structural framing such as, but not limited to eye injuries, and fall and struck-by hazards, in that the employer did not initiate and maintain a safety and health programs as necessary for accident prevention to comply with this part, which addressed the following basic elements:  1. Management Commitment and Leadership  2. Assignment of Responsibility; 3. Identification and Control of Hazards 4. Training and Education 5. Hazard Analysis

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:  a.  On the ceiling joists at a residence, located at  357 Brookgreen Way, Saint Augustine, Florida: On or about May 23, 2022, the employer exposed employees to 10 feet to 11 feet fall hazards from the second floor level to the ground level, in that, fall protection system was not utilized by employees while installing floor sheathing.  Bustos Framing, LLC, a predecessor to L & B Framing, LLC, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1563539, citation number 1, item number 2 and was affirmed as a final order on January 3, 2022, with respect to a workplace located at 1893 Carter Landing Boulevard, Lot 90, Jacksonville, Florida.  Luis Fernando Bustos-Guzman, a predecessor to Bustos Framing, LLC and L & B Framing, LLC, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1285206, citation number 1, item number 1 and was affirmed as a final order on March 21, 2018, with respect to a workplace located at 3040 Lucena Lane, Jacksonville, Florida.
