Metal containers and portable tanks meeting the requirements of and containing products authorized by chapter I, title 49 of the Code of Federal Regulations (regulations issued by the Hazardous Materials Regulations Board, Department of Transportation), shall be deemed to be acceptable: At a facility located at 108 S. Polk Street, Merrill, WI, 54452; a container of 2-butanone (MEK; flammable liquid category 2) used in the process of mold washing was not in an approved metal container authorized by chapter 1, title 49 of the Code of Federal Regulations.

29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following: On October 4, 2022, at a facility located at 108 S. Polk Street, Merrill, WI, 54452; the employer did not develop or implement procedures for controlling hazardous energy during mold changes on the Desma 24 Station Injection Machine. Mold changes required the stations to be energized for component positioning; however, the employer did not develop procedures to define the sequence of actions to accomplish the task safely by ensuring employees' hands were removed from the hazard area of the closing side-rails of the mold.

29 CFR 1910.147(f)(1): Testing or positioning of machines, equipment or components thereof. In situations in which lockout or tagout devices must be temporarily removed from the energy isolating device and the machine or equipment energized to test or position the machine, equipment or component thereof, the following sequence of actions shall be followed: Clear the machine or equipment of tools and materials, remove employees from the machine or equipment area, remove the lockout or tagout devices, energize and proceed with testing or positioning and deenergize all systems and reapply energy control measures: On October 4, 2022, at a facility located at 108 S. Polk Street, Merrill, WI, 54452; an employee conducting mold changes on the Desma 24 Station Injection Machine did not implement procedures and was not provided with supplemental safeguards to ensure their hands were removed, and stayed removed, from the hazard area of the closing side-rails of the mold. The closing of the side-rails was triggered by a one hand control while the other hand was within a foot of the caught-in hazard, which could result in laceration or amputation to hands and/or fingers.

29 CFR 1910.1200(f)(6)(ii): Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: At a facility located at 108 S. Polk Street, Merrill, WI, 54452; the multicomponent polyurethane system (Huntsman Suprasec and Daltoped) existed in part of stationary process containers with hazardous chemicals used in the injection molding of shoe soles on the Desma 24 Station Injection Machine. The employer did not ensure that the stationary containers of hazardous chemical in the workplace were labeled, tagged or marked with information regarding the physical and health hazards of the chemicals within.
