29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  On or about June 15, 2022, the employer did not ensure modifications such as a homemade hoists and/or commercially purchased hoists used on both the Yale (s/n C818V0Z170A) and Crown (s/n H004V01775L) PIVs utilized within building 5 were used with manufacturers approval. Employees are required to use the hoists to lift/move steel stock for use in the fabrication process. Employees are exposed to struck-by hazards associated with powered industrial vehicles utilized outside manufacturer's specifications

29 CFR  1910.253(b)(2)(ii):  Cylinders were not stored in areas to ensure that the cylinders would not be knocked over:  On or about June 15, 2022, the employer failed to ensure that compressed gas cylinders were stored in a definitely assigned place away from elevators, stairs, or gangways inside building number 5. Additionally, the storage space did not ensure that the cylinders would not be knocked over or damaged by passing or falling objects.  The cylinders located near mill number 5 were left unsecured and susceptible to damage from passing powered industrial vehicles and/or passing employees.

29 CFR  1910.147(c)(6)(i):The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  On or about June 15, 2022, the employer did not certify that periodic audits of the energy control procedure were completed at least annually. Employees are required to perform servicing and maintenance activities on machines, including but not limited to, welders, accumulators, and milling equipment innate to steel fabrication, which require energy control procedures that have not been reviewed for deficiencies.
