29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels or a dose of fifty percent: On or about July 11, 2024, the employer had not established and implemented an audiometric testing program for employees exposed to noise levels which exceed the action level of a dose of 50 percent. Employees working on mills and recut machines in buildings 1 and 4 were exposed to noise at levels 73.6% (87.8 dB) to 151.4% (92.9 dB) of the permissible daily dose as measured over 524 minutes to 548 minutes of sampling.

29 CFR 1910.95(i)(2)(ii)(A): The employer did not ensure that hearing protectors are worn by any employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater and has not yet had a baseline audiogram established pursuant to 29 CFR 1910.95(g)(5)(ii): On or about July 11, 2024, the employer did not require and ensure employees exposed to noise levels exceeding the action level of 85 decibels or a dose of 50 percent while working on weld steel tube mills and recut machines wore hearing protection in the work environment prior to receiving baseline audiograms. Employees working on mills and recut machines in buildings 1 and 4 were exposed to noise at levels 73.6% (87.8dB) to 151.4% (92.9 dB) of the permissible daily dose as measured over 524 minutes to 548 minutes of sampling.

On or about July 11, 2024, the employer did not ensure all employees exposed to noise levels exceeding the action level of 85 decibels or a dose of 50 percent while working on weld steel tube mills and recut machines were trained on the effects of noise, the purpose of hearing protectors, the purpose of audiometric testing and an explanation of audiometric test procedures.
