OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to Struck-by/Caught between hazards associated with a potential for overloading of the storage rack systems:   a)	Gasbarre Products, Inc. dba Sinterite Furnace Division, Bay 3 racking system, on or about June 23rd 2022 and times prior thereto:  The load ratings for the Bay 3 racking systems were not displayed and/or conveyed to employees.  The storage racks were used to store items including, but not limited to, metal beams and metal tubing/pipes.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR  1910.107(b)(5)(iv):Space within the spray booth on the downstream and upstream sides of filters were not protected with approved automatic sprinklers:  a)	Gasbarre Products, Inc. dba Sinterite Furnace Division, paint booth area-bay 4, on or about June 23rd, 2022 and times prior thereto:  The automatic sprinklers on the downstream and upstream sides of filters in the paint booth area were not functional in that, the water system associated with delivering water to the paint booth was not operational.  Throughout each work shift, employees were potentially exposed to a fire hazard at the employer's paint booths where flammable materials were sprayed.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1910.107(b)(9):A clear space of not less than 3 feet on all sides was not kept free from storage or combustible construction:   a)	Gasbarre Products, Inc. dba Sinterite Furnace Division, paint booth area-bay 4, on or about June 23rd, 2022 and times prior thereto:  Employees performed spray painting/coating in the bay 4 paint booth area.  Materials including, but not limited to, cardboard boxes, wooden shelves, flammable paint cabinets, storage tables/desks, and storage cabinets were stored within three feet of the spray booth.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). 29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a)	Gasbarre Products, Inc. dba Sinterite Furnace Division, various areas throughout the facility, on or about June 23rd, 2022 and times prior thereto:  Some employees were required to wear full facepiece elastomeric respirators (Honeywell/North brand 7600 series P/N 80802) with combination cartridges during work tasks including, but not limited to, spray painting operations.   Some employees were not provided with a medical evaluation for respirator use prior the required use of the full facemask respirators.     ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). Gasbarre Products, Inc. dba Sinterite Furnace Division, Bay 3 racking system, on or about June 23rd, 2022 and times prior thereto:  The storage of various metal parts including, but not limited to, metal beams and metal pipes/tubes located on the Bay 3 racking system created a potential struck-by hazard to employees while loading/unloading items onto and off of the rack.  Metal products were stored above the safety guard on the racking system. 29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a)	Gasbarre Products, Inc. dba Sinterite Furnace Division, various areas throughout the facility, on or about June 23rd, 2022 and times prior thereto:  Employees worked with and around hazardous substances including, but not limited to, Sherman Williams brand Kem Acryl HS 100, and hexavalent chromium during painting and welding operations.  The employer did not provide hazard communication training for all employees who worked with and around hazardous substances.
