29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a) Rojas Brothers Construction LLC, at a jobsite located at 138 Chapman Drive, Lot 323, Pataskala, Ohio 43062: On and/or preceding July 20, 2022, where there was possible danger of head injury from impact or from falling or flying objects, the employer failed to ensure employees' heads were protected by protective helmets. An employee, without any means of head protection, worked at ground level while an employee was sheathing the roof above, thereby being exposed to a struck-by hazard.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step.  a) Rojas Brothers Construction LLC, at a jobsite located at 138 Chapman Drive, Lot 323, Pataskala, Ohio 43062: On and/or preceding July 20, 2022, the employer failed to ensure employees did not use the top or top step of a step ladder. Employees used a step ladder to access the second story, while stepping on the top and top step of the ladder, thereby exposing the employees to an 8-foot fall hazard.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Rojas Brothers Construction LLC, at a jobsite located at 138 Chapman Drive, Lot 323, Pataskala, Ohio 43062: On and/or preceding July 20, 2022, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees, without fall protection, were sheathing the roof, thereby exposed to fall hazards of up to 20 feet.  Rojas Brothers Construction LLC was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1481700, citation number 2, item number 3 and was affirmed as a final order on August 18, 2020, with respect to a workplace located at Woodland Sky Drive, Lot 123, Pataskala, Ohio 43062.  Rojas Brothers Construction LLC was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1446796, citation number 1, item number 1 and was affirmed as a final order on April 15, 2020, with respect to a workplace located at 151 and 153 Broadmoore Blvd, Lots 90A and 90B, PATASKALA, OH, 43062.  Miguel Ramirez, the owner of Rojas Brother Construction LLC, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1378451, citation number 1 item number 3 and was affirmed as a final order on March 26, 2019, with respect to a workplace located at 7267 Monarch Street, Canal Winchester, OH 43110.

Employees used an extension cord that was missing the ground prong, thereby being exposed to a 123-volt electrical contact hazard.
