29 CFR 1910.147(c)(4)(ii):  Energy control procedure. The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  29 CFR 1910.147(c)(4)(ii)(D): Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.  a. On or about August 10, 2022, the specific procedure for hazardous energy control (lockout/tagout) of Laminator 3 did not include specific requirements for testing the equipment to determine and verify the effectiveness of the energy control measures required by the procedure.  Covered activities involved with Laminator 3 equipment includes maintenance, repair, cleaning, set-up and servicing duties performed by maintenance employees, machine operators and machine operator helpers. During the performance of these required duties, employees have exposure to potential nip point, caught-in hazards and struck-by hazards associated with the machines, equipment and powered mechanisms associated with the Laminator 3 machine line such as the adhesive station, the coating station and the trolly station.

29 CFR  1910.147(c)(7)(i)(A):Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a. On or about August 1, 2022, the employer failed to train a machine operator helper on the specific energy control procedures for Laminator 3 prior to the employee performing activities covered by this part.  On this date, the employee was not instructed in the methods and means necessary for energy isolation and control, such as specific procedures for performing lockout/tagout on Laminator 3 while cleaning, servicing and performing set-up duties in the Coating station areas. During covered activities required by the employer, operators and operator helpers have exposure to caught-in and pinch point hazards from Laminator equipment such as, but not limited to, powered rollers associated with Laminator 3.  b. On or about and prior to August 10, 2022, the employer failed to assure that authorized employees on Laminators 2, 3 ,4 and 5 received training regarding use of lockout/tagout during cleaning activities. During cleaning activities, operators and operator helpers are only required to use operational controls and do not apply controls as required by 29 CFR 1910.147(d). These employees are subject to pinch point and caught-in hazards and are not required to apply appropriate energy isolation, such as but not limited to, engagement of electrical disconnect switches and subsequent application of lockout devices for control of hazardous energy when performing required cleaning duties

29 CFR 1910.147(d):   Application of control. The established procedure for the application of energy control (the lockout or tagout procedure) was not done in the sequence required by 29 CFR 1910.147(d)(1) through (d)(6):  a. On or about and prior to August 10, 2022, the employer failed to ensure that established procedures for the control of hazardous energy were applied for covered activities performed that included cleaning activities in the danger zone of Laminator 3 equipment. During cleaning that occurred at the end of the shift on August 1, 2022, a machine operator was not protected during this covered activity and suffered a partial amputation of the right index finger while cleaning in the Laminator 3 coating station.  The accident victim was not protected by the orderly shutdown of the equipment according to the procedures, the operation of energy isolation devices and the affixing of lockout devices to energy isolation devices.  During these activities, employees have exposure to caught-in hazards, pinch point hazards and rotating parts hazards.  b. On or about and prior to August 10, 2022, the employer failed to ensure that established procedures for the control of hazardous energy were applied for covered activities in the danger zone of Laminator 3 equipment. Following the accident that occurred on August 1, 2022, a machine operator helper performed required duties covered by this part that included machine servicing and cleanup activities in the danger zone of Laminator 3 equipment. The machine operator helper was not protected by the operation of energy isolation devices and the affixing of lockout device to energy isolation devices. During these activities, employees have exposure to caught-in hazards, pinch point hazards and rotating parts hazards.  c. On or about and prior to August 10, 2022, the employer failed to ensure that established procedures for the control of hazardous energy were applied for covered activities performed that included cleaning activities in the danger zone of Laminator 3 equipment. On August 9, 2022, a machine operator performed required duties covered by this part, cleaning activities of Laminator 3 equipment, which included the doctor blade area of the coating station. The machine operator was not protected by the operation of energy isolation devices and the affixing of lockout device to energy isolation devices. During these activities, employees have exposure to caught-in hazards, pinch point hazards and rotating parts hazards.

29 CFR  1910.25(b): General requirements. The employer must ensure:  29 CFR  1910.25(b)(1): Handrails, stair rail systems, and guardrail systems are provided in accordance with 29 CFR 1910.28;  a. On or about August 10, 2022, the employer failed to assure that the fixed stairway for the Laminator 2 platform was provided a stair rail system for the open sides that complied with 29 CFR 1910.28 of this part. The stair rail system did not have midrail components.
