29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  On or about August 29, 2022, at a worksite located at 600 E. Carrington Ln, Appleton Wisconsin 54913: two employees were performing residential roofing activities while being tied into one anchor point with multiple lanyards.

29 CFR  1926.502(d)(17): The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head.  On or about August 29, 2022, at a worksite located at 600 E. Carrington Ln, Appleton Wisconsin 54913: one employee was performing residential roofing activities with a fall hazard of 18 feet seven inches and did not attach their fall arrest components to a point near the center of their back.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about August 29, 2022, at a worksite located at 600 E. Carrington Ln, Appleton Wisconsin 54913: employees were utilizing a two metal extension ladders that did not extend three feet above the roof surface.   a. Five employees were utilizing a metal extension ladder at the front of the house and were exposed to a fall hazard of approximately 18 feet 8 inches as the ladder was used for accessing and egressing the roof from the ground and did not extend three feet above the roof surface.   b. Two employees were utilizing a metal extension ladder at the side of the house and were exposed to a fall hazard of approximately nine feet one inch as the ladder was used for accessing and egressing the roof from the ground and did not extend three feet above the roof surface.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Daniels Roofing & Framing LLC located in Rockford, Illinois does not ensure that employees engaged in residential roofing activities are protected from fall hazards. This violation was most recently observed on or about August 29, 2022, at a worksite located at 600 E. Carrington Ln, Appleton Wisconsin 54913, employees were performing residential roofing activities without any form of conventional fall protection while exposed to falls of approximately 18 feet seven inches.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  Daniels Roofing & Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1596034, citation number 1, item number 1 and was affirmed as a final order on August 30, 2022, with respect to a workplace located at N1454 Westgreen Dr., Greenville, Wisconsin.  Daniels Roofing & Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1609852, citation number 1, item number 2 and was affirmed as a final order on August 30, 2022, with respect to a workplace located at 501 E Apple Creek Rd. Appleton, Wisconsin.  Daniels Roofing & Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1612435, citation number 1, item number 1 and was affirmed as a final order on August 30, 2022, with respect to a workplace located at 4509 N. Marshall Heights Ave., Appleton, Wisconsin.
