29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):   On or about August 8, 2023, employees performing roofing work were exposed to eye injuries and fall hazards of approximately 8.5 feet and the employer did not ensure a competent person inspected the site in order to control or eliminate the hazards.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  On or about August 8, 2023, an employee using a pneumatic nail gun was exposed to eye injuries and the employer did not ensure safety glasses were used.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about August 8, 2023, employees performing roofing operations were exposed to fall hazards of approximately 8.5 feet and the employer did not ensure fall protection was used:  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  Daniels Roofing & Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1617847, citation number 2, item number 1 and was affirmed as a final order on November 30, 2022, with respect to a workplace located at 600 E Carrington Ln, Appleton, Wisconsin.  Daniels Roofing & Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1612435, citation number 1, item number 1 and was affirmed as a final order on August 30, 2022, with respect to a workplace located at 4509 N. Marshall Heights Ave., Appleton, Wisconsin.  Daniels Roofing & Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1609852, citation number 1, item number 2 and was affirmed as a final order on August 30, 2022, with respect to a workplace located at 501 E Apple Creek Rd. Appleton, Wisconsin.
