OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards. location: Centre Ave. on or about: 9/9/22 a) An employee, engaged in construction debris clean-up, was exposed to crush-by hazards while operating a Genie GTH-2506 telehandler forklift. The employer did not ensure that seat belts were used. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

Seat belts for agricultural and light industrial tractors did not meet the seat belt requirements of Society of Automotive Engineers J333a-1970, Operator Protection for Agricultural and Light Industrial Tractors. location: Centre Ave. on or about: 9/9/22 a) An employee, operating a Bobcat E55 compact excavator, was exposed to crush-by hazards. The employer did not ensure that seat belts were used. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
