29 CFR 1910.213(r) Miscellaneous woodworking machines. 29 CFR 1910.213(r)(4): The mention of specific machines in paragraphs (a) thru (q) and this paragraph (r) of this section, inclusive, is not intended to exclude other woodworking machines from the requirement that suitable guards and exhaust hoods be provided to reduce to a minimum the hazard due to the point of operation of such machines. a) On or about May 25, 2022, the employer did not ensure that the Heart Edger 3 (Brewer, Inc. model Edger) was adequately guarded in that the safety fingers did not protect employees from kickback, causing injury and hospitalization of Employee #1. Per employee interviews, other injuries have occurred due to kickback on Heart Edger 3, including finger lacerations that required bandages from the first aid kit located in the office area. b) On or about October 18, 2022, the employer did not ensure that the Halving Saw (Brewer, Inc. model Brewer Inc. Halving saw) was adequately guarded in that the operation controls are approximately 2 feet from the exposed saw blades and log cradles, with the opening of the saw blades measuring approximately 35 inches by 41 inches. c) On or about October 18, 2022, the employer did not ensure that the Quarter Saw (Brewer, Inc. model Quarter Saw) was adequately guarded in that the operator controls to the log rollers measures approximately 18 inches, and to the saw blade guard measuring approximately 3.5 feet. d) On or about October 18, 2022, the employer did not ensure that the Stave Saw 1 (BrewCo model Stave Saw) was adequately guarded in that the saw blade is approximately 4 inches from the guard, with an exposed blade opening measuring approximately 20 inches by 21 inches, allowing employees to access the rotating blade. e) On or about October 18, 2022, the employer did not ensure that the Stave Saw 2 (Brewer, Inc. model G.E. Stave 52808) was adequately guarded in that the saw blade is approximately 4 inches from the guard, with an exposed blade opening measuring approximately 20 inches by 21 inches, allowing employees to access the rotating blade. f) On or about October 18, 2022, the employer did not ensure that the Stave Saw 3 (Brewer, Inc. model Stave Saw 2915-9) was adequately guarded in that the saw blade is approximately 4 inches from the guard, with an exposed blade opening measuring approximately 20 inches by 21 inches, allowing employees to access the rotating blade. g) On or about October 18, 2022, the employer did not ensure that the Heart Edger 1 (BrewCo model Edger BEB1579) was adequately guarded in that the safety fingers did not protect employees from kickback. h) On or about October 18, 2022, the employer did not ensure that the Heart Edger 2 (Brewer, Inc. model Edger) was adequately guarded in that the safety fingers did not protect employees from kickback. i) On or about October 18, 2022, the employer did not ensure that the Buck Saw (CSI model DL-4400) was adequately guarded in that the operator control station is approximately 2 feet from the saw blade and log cradle, allowing employees to reach under the guard to the point of operation. j) On or about October 18, 2022, the employer did not ensure that the Heading Saw (Brewer, Inc. model Double Trim Saw) was adequately guarded in that employees are exposed to the sawblade, measuring approximately 13 inches, from the rubber sheeting.

29 CFR 1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about May 25, 2022, the employer did not report the hospitalization of an injured employee within 24 hours. The injured employee was taken to the emergency room at a local hospital by the employer, Bandon Bush (Mill Manager). Employee #1 was transferred to another hospital, had required surgery to remove the wood and was discharged the next morning.
