29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. At the establishment located at 1900 Enterprise Drive, De Pere, Wisconsin; in the Core Room, the employer did not provide personal protective equipment, such as but not limited to chemical-resistant clothing, to protect each employee from body chemical burn hazards presented when calibrating the Core Room Mixer. On or about October 3, 2022, an employee suffering from chemical burns was hospitalized due to an explosion after mixing an acid/catalyst (TW30 XSP Acid Catalyst) and a binder/resin (Airkure 241EXS FNB Resin), and was not provided with effective personal protective equipment.

29 CFR 1910.132(d)(1)(i): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment. At the establishment located at 1900 Enterprise Drive, De Pere, Wisconsin; in the Core Room, the employer did not select and require the use of personal protective equipment that would protect each employee from the hazards identified in the hazard assessment while calibrating the Core Room Mixer, such as but not limited to chemical-resistant clothing, exposing each employee to chemical hazards. At the establishment located at 1900 Enterprise Drive, De Pere, Wisconsin; in the Core Room, the employer did not ensure that where eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were provided within the work area for immediate emergency use, exposing each employee that worked with injurious corrosive materials, such as but not limited to TW30 XSP Acid Catalyst, to chemical hazards. On or about October 3, 2022, an employee suffering from chemical burns was hospitalized due to an explosion after mixing an acid/catalyst (TW30 XSP Acid Catalyst) and a binder/resin (Airkure 241EXS FNB Resin) without a means to flush the body within the work area.

29 CFR 1910.303(g)(1): Sufficient access and working space shall be provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment. At the establishment located at 1900 Enterprise Drive, De Pere, Wisconsin; in the Core Room, the employer did not provide sufficient access and working space to electrical disconnects, exposing employees to electrical hazards in the following instances: a) The Core Room Conveyors electrical disconnect mounted on the Mixer was blocked by storage rails and did not provide at least three feet of clear working space. b) The Flow Coater electrical disconnect mounted on the east wall was blocked by cross bracing and did not provide at least three feet of clear working space. c) The Core Room North Hoist Disconnect mounted on the east wall was blocked by two 55-gallon drums and did not provide at least three feet of clear working space.

At the establishment located at 1900 Enterprise Drive, De Pere, Wisconsin; the employer's list of hazardous chemicals did not account for all chemicals known to be present in the workplace, such as but not limited to Airkure 241EXS FNB Resin and TW30 XSP Acid Catalyst.
