29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about 10/28/2022, at Parkview Place (Lot 323) located on 4098 Lyell Road, in Rochester, New York, the employer did not enforce the use of fall protection during the framing of a 2-story home. The employer allowed employees to install framing material without fall protection and exposing them to falls of 16 feet above lower levels. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access. a) On or about 10/28/2022, at Parkview Place (Lot 323) located on 4098 Lyell Road, in Rochester, New York, the employer did not enforce safe ladder use. The employer allowed employees to use a portable ladder to access a roof without ensuring that the ladder side rails extended 3 feet above the roof landing and exposed them to falling 12 feet to lower levels. NO ABATEMENT CERTIFICATION REQUIRED
