29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a- 59 Senator's Way, Berlin NJ: Workers were exposed to eye/face injuries when using air nailers without the use of eye/face protection when performing roof underlayment and shingle installation activities at the worksite. Condition observed on or about 11/03/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: a- 62 Senator's Way, Berlin NJ: Company workers were exposed to fall hazards, in excess of 10 feet 6 inches to the ground surface below, when walking and working from a residential structure's pitched roofs while incorrectly using fall protection. Condition observed on or about 11/03/22. b- 62 Senator's Way, Berlin NJ: A company worker was exposed to fall hazards, in excess of 14 feet 8 inches to the ground surface below, when walking and working from a residential structure's pitched roofs while wearing a full body harness that was not connected to an anchor with a lanyard. Condition observed on or about 11/03/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
