29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a- 8 Earlington Avenue, Mullica Hill NJ: The company worksite Foreman was exposed to fall hazards when working from a portable aluminum extension ladder's fly section whose side rails did not extend at least three feet above the pitched roof they were applying shingles to and performing other related activities. Condition observed on or about 03/08/24.  b - 8 Earlington Avenue, Mullica Hill NJ: The company worksite Foreman was exposed to fall hazards when working from an aluminum extension ladder whose side rails did not extend at least three feet above the pitched roof they applying shingles to and performing other related activities. Condition observed on or about 03/08/24. 29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.   a- 8 Earlington Avenue, Mullica Hill NJ: The company worksite Foreman was exposed to fall hazards when working from a damaged,portable aluminum extension ladder's fly section containing damaged rungs and no feet.  Condition observed on or about 03/08/24.  b - 8 Earlington Avenue, Mullica Hill NJ: The company worksite Foreman was exposed to fall hazards when working from an aluminum extension ladder that contained damaged rungs, bent side rails, etc..  Condition observed on or about 03/08/24.  Dynamic General Services, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.1053(b)(16)), which was contained in OSHA inspection number 1675156, citation number 2, item number 2 and was affirmed as a final order on 01/31/24, with respect to a workplace located at 218-223 Stanton Road in Mount Holly NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.   a- 8 Earlington Avenue, Mullica Hill NJ: The company worksite Foreman was exposed to fall hazards when performing roofing related activities on a residential structure's pitched porch roof while improperly using a damaged aluminum extension ladder's fly section and a damaged aluminum extension ladder.  This worksite Foreman had not received training that would have allowed them to recognize hazards related to ladders and the procedures to be followed to minimize these hazards.  Condition observed on or about 03/08/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. Condition observed on or about  03/08/24.  Dynamic  General Services, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.102(a)(1)), which was contained in OSHA inspection number 1632443, citation number 1, item number 1 and was affirmed as a final order on  03/28/23, with respect to a workplace located at 59 Senator's Way, Berlin NJ.
