29 CFR  1910.132(b): Where employees provide their own protective equipment, the employer did not assure its adequacy, including proper maintenance, and sanitation of such equipment:  Elyria Foundry Company, LLC - Elyria, Ohio: On or about October 28, 2022, the employer did not ensure that employee-provided clothing, used to protect against burn injuries from flying sparks in the cleaning department, was adequate in that synthetic materials were worn.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment:   a. Elyria Foundry Company, LLC - Elyria, Ohio: On or about October 28, 2022, the employer's hazard assessment did not protect employees in the cleaning department from sparks and fire hazards.  The employer did not select and have affected employees use personal protective equipment that would protect against burn injuries when grinding/cutting metal in that synthetic items such as, clothing, respirator shroud, and apron were utilized.  An employee cutting a riser from a casting sustained burn injuries when their clothing caught fire.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Elyria Foundry Company, LLC - Elyria, Ohio: On or about October 28, 2022, the employer did not ensure cleaning room employees who were required to wear clothing and/or flame-resistant sleeves to protect against burn injury were trained in what fabric material would provide protection.  Employees who performed metal cutting/cleaning operations were exposed to burns and fire hazards.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Elyria Foundry Company, LLC - Elyria, Ohio: On or about October 28, 2022, the employer did not ensure cleaning room employees who were required to wear clothing and/or flame-resistant sleeves to protect against burn injury were trained in the care, maintenance, and useful life of the personal protective equipment (PPE).  Employees who performed metal cutting/cleaning operations were exposed to burns and fire hazards in that the protective clothing and/or PPE was contaminated with oil was utilized.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
