29 CFR  1910.28(b)(2)(i):(2) Hoist areas.  The employer must ensure: (i) Each employee in a hoist area is protected from falling 4 feet (1.2 m) or more to a lower level by:  a. On or about November 28, 2022, in building 3655, the gate to the second story hoist area in the south-east area of the warehouse was secured open while employees were working within close proximity to the unprotected edge, thereby exposing employees to fall hazards from up to approximately twelve feet to the concrete floor.  b. On or about November 28, 2022, in building 3655, the gate to the second story hoist area in the south-central area of the warehouse was secured open while employees were working within close proximity to the unprotected edge, thereby exposing employees to fall hazards from up to approximately twelve feet to the concrete floor.  c. On or about November 28, 2022, in building 3655, the second story hoist area in the south-west of the warehouse had a chain gate that was not connected to protect employees while employees were working within close proximity to the unprotected edge, thereby exposing employees to fall hazards from up to approximately twelve feet to the concrete floor.

29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.   a. On or about November 28, 2022, the employer did not ensure that each employee operating powered industrial trucks onsite were re-evaluated every three years to ensure safe operating performance.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  a. On or about November 28, 2022, the employer did not ensure that powered industrial trucks were being inspected prior to use on each shift, thereby exposing the employees to struck by hazards.

29 CFR 1910.303(g)(1)(ii): Working space required by this standard may not be used for storage. When normally enclosed live parts are exposed for inspection or servicing, the working space, if in a passageway or general open space, shall be suitably guarded.  a. On or about November 28, 2022, the employer did not ensure that the area in front of the electrical panel located on the southeast wall of building 3655 remained clear of material storage to ensure safe access to the equipment.
