29 CFR 1910.140(c)(13)(ii): Designed, installed, and used, under the supervision of qualified person, as part of a complete personal fall protection system that maintains a safety factor of at least two. On or about February 1, 2023, at an establishment located at 2121 Cleveland Avenue in Marinette, Wisconsin, an employee of Samuel Pressure Vessel Group was working outside of the platform of a Genie Z-30/20N aerial lift while utilizing a personal fall arrest system that was attached to the lifts anchor point. The platform anchor point was not designed to have employees entering or exiting the platform unless the machine was in the stowed position and at ground level.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): On or about February 1, 2023, at an establishment located at 2121 Cleveland Avenue in Marinette, Wisconsin, two employees were exposed to machine hazards associated with moving parts when they engaged in maintenance activities on a CNC machine. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to commence work. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR 1910.147(f)(3)(ii)(D): Each authorized employee shall affix a personal lockout or tagout device to the group lockout device, group lockbox, or comparable mechanism when he or she begins work, and shall remove those devices when he or she stops working on the machine or equipment being serviced or maintained. On or about February 1, 2023, at an establishment located at 2121 Cleveland Avenue in Marinette, Wisconsin, two employees of Samuel Pressure Vessel Group were working on a CNC machine to replace a hydraulic line. One employee did not affix a personal lockout or tagout device during the servicing activity.
