29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The employer failed to submit to OSHA within 10 calendar days of 8/31/23, documentation of abatement of citation 1, item 1 issued in this case under 29 CFR 1926.503(a)(1)   NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   Location: entire site On or about: 3/1/23  a) The employer does not ensure that each employee is provided with fall protection training. A recent instance of this violation was observed on 3/1/23 when untrained employees were installing wooden roof decking on a three story 6-unit residential building. The employees were exposed to a fall of 28-31ft., to the ground below.  Note: In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  Location: roof On or about: 3/1/23  a) Maestro Contracting does not ensure that each employee uses fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about March 1st, 2023, at 37 Mezritch Rd., New Square, NY 10977, when employees installing wooden roof decking on a three story 6-unit residential building were not provided with any means of fall protection. The employees were exposed to a fall hazard of approximately 28-31 ft., to the ground below.
