29 CFR 1910.178(m)(3): Unauthorized personnel were permitted to ride on industrial truck(s): The employer is failing to protect employees from fall hazards. This was most recently documented on or about February 27th, 2023 at the jobsite located at 11710 Brookview Circle in Wichita, Kansas. Employees engaged in residential framing activities are exposed to fall hazards in that employees are riding and standing in a wooden job-made basket being lifted by the Genie GTH-636 all terrain forklift. The fall distance is 11 feet 8 inches, from the level of the first story eave to the ground below, and no fall protection is being utilized.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: The employer is failing to protect employees from fall hazards. This was most recently documented on or about February 27th, 2023 at the jobsite located at 11710 Brookview Circle in Wichita, Kansas. Employees engaged in residential framing activities, walking the top plates, are exposed to fall hazards of approximately 11 feet 8 inches feet to the exterior ground below in that fall protection is not being utilized. Brent Lawrenz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1635210, citation number 1, item number 4 and was affirmed as a final order on 03-03-2023, with respect to a workplace located at 4501 Bluestem in Maize, Kansas.
