29 CFR  1926.1052(c)(12):Unprotected sides and edges of stairway landings were not provided with guardrail systems which met the criteria contained in Subpart M of 29 CFR 1926:00:  At the jobsite located at 3019 Crystal Beach, Wichita Kansas, employees engaged in framing activities on the second floor of the building were exposed to fall hazards in that a guardrail system was not in place around the stairwell opening to prevent employees from fall hazards.

29 CFR 1910.178(l): Operators were not trained in the safe operation of powered industrial trucks:  The employer fails to train and evaluate employees to ensure they are competent to operate powered industrial trucks safely.  This was most recently documented on September 30, 2024, and October 01, 2024 at 3109 Crystal Beach, Wichita KS on October 01, 2024,  when employees engaged in residential framing activities were exposed to serious crushing and struck-by injuries when an employee operating a forklift had not completed a forklift training program that met the requirements of OSHA standard 1910.178(l) powered industrial trucks, operator training.  To abate this violation, the employer must train and evaluate its employees who will operate powered industrial trucks as required by 29 CFR 1910.178(l).  Pursuant to 29 CFR 1903.19, the employer must submit documentation describing the steps it is taking to ensure compliance at future worksites.  Brent Lawrenz DBA BML Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1910.178(I), which was contained in OSHA inspection number 1495225, citation number 1, item number 1, and was affirmed as a final order on 3/25/2021, with respect to a workplace located at 6532 W. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail system(s), safety net system(s), or personal fall arrest system(s), nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b)  The employer fails to ensure employees are protected from fall hazards when engaged in framing activities for residential construction.  This was most recently documented on September 30, 2024, and October 01, 2024, at 3109 Crystal Beach, Wichita KS, where employees engaged in residential framing activities at heights greater than 6 feet above ground level were not using any form of fall protection.  To abate this violation, the employer must ensure its employees engaged in residential framing activities are protected from falls, and that no employee is allowed to work at heights of 6 feet or more above a lower level without adequate fall protection. Pursuant to 29 CFR 1903.19, the employer must submit documentation describing the steps it is taking to ensure compliance at future worksites, including a description of how these steps protect its employees from fall hazards. 29 CFR 1926.1053(b)(13): The top step of a stepladder was used as a step:  The employer fails to protect employees from fall hazards when using ladders. This was most recently documented on September 30, 2024, and October 01, 2024, at 3109 Crystal Beach, Wichita KS, when employees engaged in residential framing activities were using the top step of a Werner 8 foot A-frame ladder to access the upper level of a house under construction.  To abate this violation, the employer must ensure its employees engaged in residential construction do not use the top step of a stepladder as a step.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance at future worksites, including a description of how these steps protect its employees from fall hazards.
