29 CFR 1910.1200(e)(1): The employer had not developed and implemented a written hazard communication program, maintained at each workplace, that describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) (list of hazardous chemical using a product identifier) and (e)(1)(ii) (methods to inform employees of the hazards of non-routine tasks): (Construction Reference: 1926.59).  The employer fails to develop and implement a written hazard communication program for its worksites which describes how the program is implemented, the required labeling and maintenance of safety data sheets on site, and how employees will be informed and trained. This was most recently documented at a jobsite located at 9631 Wilkinson Ct, Maize, KS  where employees were exposed to hazardous chemicals including gasoline yet there was no written hazard communication program, training and information, labeling or safety data sheets available.  Gasoline is an extremely flammable liquid and vapor, causes skin irritation, may cause genetic defects, may cause cancer and may cause drowsiness or dizziness.  Brent Lawrenz dba BML Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 1778602, citation number 1, item number 1, and was affirmed as a final order on 02-26-2025, with respect to a workplace located at 3109 Crystal Beach, Wichita, KS.  Brent Lawrenz dba BML Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 1635219, citation number 1, item number 1a, and was affirmed as a final order on 03-02-2023, with respect to a workplace located at 4501 Bluestem, Maize, KS.

The employer fails to maintain safety data sheets for each hazardous chemical at its worksites. This was most recently demonstrated at the jobsite located at 9631 Wilkinson Ct, Maize, KS where there were no safety data sheets for the hazardous chemicals employees used, including but not limited to gasoline which is an extremely flammable liquid and vapor, causes skin irritation, may cause genetic defects, may cause cancer and may cause drowsiness or dizziness. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new chemical hazard that the employees had not been previously trained about was introduced into their work area:  The employer fails to provide its employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment and when a new chemical hazard not previously trained about is introduced to their workplace. This was most recently demonstrated at the jobsite located at 9631 Wilkinson Ct, Maize, KS where the employer did not provide effective information and training to employees exposed to hazardous chemicals to enable them to recognize, evaluate, and control exposure to hazardous chemicals, including but not limited to gasoline, which is an extremely flammable liquid and vapor, causes skin irritation, may cause genetic defects, may cause cancer and may cause drowsiness or dizziness.
