29 CFR 1910.178(l): Operators were not trained in the safe operation of powered industrial trucks:  The employer fails to train and evaluate employees to ensure they are competent to operate powered industrial trucks safely.  This was most recently documented on March 12, 2025, at 9631 Wilkinson Ct. Maize, KS,  when employees engaged in residential framing activities were exposed to serious crushing and struck-by injuries when an employee operating a forklift had not completed a forklift training program that met the requirements of OSHA standard 1910.178(l) powered industrial trucks, operator training.  To abate this violation, the employer must train and evaluate its employees who will operate powered industrial trucks as required by 29 CFR 1910.178(l).  Pursuant to 29 CFR 1903.19, the employer must submit documentation describing the steps it is taking to ensure compliance at future worksites. 29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  The employer fails to ensure employees are protected from stuck-by hazards by wearing protective helmets when engaged in framing activities for residential construction.  This was most recently documented on March 12, 2025, at 9631 Wilkinson Ct. Maize, KS, where employees working below other employees engaged in framing activities not provided with head protection and therefore were exposed to struck-by hazards.    To abate this violation, the employer must ensure its employees engaged in residential construction wear hard hats while working below other employees when potential for struck-by hazards exist.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance at future worksites, including a description of how these steps protect its employees from struck by hazards. This was most recently documented on March 12, 2025, at 9631 Wilkinson Ct. Maize, KS, where employees working with pneumatic nail guns and manual hammers were not provided with eye protection, thereby exposing them to struck-by hazards.   To abate this violation, the employer must ensure its employees engaged in residential construction wear eye protection while working in proximity to or with pneumatic nail guns and manual hammers to protect against struck-by hazards. This was most recently documented on March 12, 2025, at 9631 Wilkinson Ct. Maize, KS, where employees were exposed to fall hazards when they engaged in residential framing activities at heights greater than 6 feet above ground level and did not use any form of fall protection.  To abate this violation, the employer must ensure its employees engaged in residential framing activities are protected from fall hazards, and that no employee is allowed to work at heights of 6 feet or more above a lower level without adequate fall protection. 29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  The employer fails to ensure employees are protected from fall hazards by extending ladders at least three feet beyond the upper landing of the work surface when engaged in framing activities for residential construction.  This was most recently documented on March 12, 2025, at 9631 Wilkinson Ct. Maize, KS, where employees engaged in residential framing activities were exposed to fall hazards when they used an extension ladder that did not extend at least three feet beyond the upper landing of the working surface nor was the ladder secured to the structure.   To abate this violation, the employer must ensure its employees engaged in residential framing activities are protected from fall hazards, and that no employee is allowed to use an extension ladder without extending it at least three feet beyond the upper landing of the working surface, or securing the ladder to the structure. 29 CFR  1904.7(a): The employer did not record workplace injuries and illnesses that would be considered to meet the general recording criteria, and therefore to be recordable, if it results in any of the following: death, days away from work, restricted work or transfer to another job, medical treatment beyond first aid, or loss of consciousness. The employer must also consider a case to meet the general recording criteria if it involves a significant injury or illness diagnosed by a physician or other licensed health care professional, even if it does not result in death, days away from work, restricted work or job transfer, medical treatment beyond first aid, or loss of consciousness.  The employer fails to maintain and provide OSHA with documents recording workplace injuries and illnesses forms (300 and 300A logs), including the years 2021-2025. The employer reportedly employs 10 to 12 employees. The employer is federally mandated to maintain these records.  To abate this violation, the employer must keep injury and illness records and annual summaries as required by 29 CFR 1904.7. The employer must provide these records to OSHA when requested.
