29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) 86 Division Ave, Spring Valley, NY (Single Family Frame Home): Employees engaged in roofing work were using a hand held circular saw without eye and face protection. The employer did not ensure that employees exposed to flying particles, were wearing eye and face protection, thus exposing employees to an eye and face injury, on or about 3/7/23.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) 86 Division Ave, Spring Valley, NY (Exterior Front of Single Family Frame Home): Employees were required to install roofing material on a residential home, and were exposed to a fall hazard of over 25 feet above the lower surface, without the use of a personal fall arrest system. The employer did not ensure that employees were provided with a personal fall arrest system, or other means of fall protection, thus exposing employees to a fall hazard, on or about 3/7/23.  Construction By Allison, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard. 1926.503(b)(13), which was contained in OSHA inspection number 1559241, citation number 001, item number 001, and was affirmed as a final order on 2/14/22, with respect to a workplace located at 75-77 Somerset Drive, Suffern, NY 10901.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) 86 Division Ave, Spring Valley NY (Exterior Rear): Employees engaged in roofing work were required to access the roof from an extension ladder, and the extension ladder did not extend at least 3 feet above the roof's landing. The employer did not ensure that an extension ladder used to access the roof, was extended to at least 3 feet above the upper landing surface, on or about 3/7/23.  b) 86 Division Ave, Spring Valley NY (Exterior Front): Employees engaged in roofing work were required to access the roof from an extension ladder, and the extension ladder did not extend at least 3 feet above the roof's landing.
