29 CFR  1926.300(b)(4)(ii):The point of operation of machine(s) whose operation exposed an employee to injury was not guarded:  a) Worksite was located at 180 Brighton Avenue, Long Branch, NJ 07740  A worker was exposed to amputation hazards as he was cutting Azek Frieze Boards with a DeWalt DWE 7485 Compact Jobsite Table Saw that had no blade guard at the point of operation.  Violation was observed on or about March 15, 2023.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(b)(2):Scaffold platforms and walkways were not at least 18 inches wide:  a) Worksite was located at 180 Brighton Avenue, Long Branch, NJ 07740  Two workers were exposed to fall hazards as the scaffold plank they were working from to work on the roofing trim was approximately ten inches wide.  Violation was observed on or about March 15, 2023.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a) Worksite was located at 180 Brighton Avenue, Long Branch, NJ 07740  The scaffold that was erected on site that workers were installing siding and trim from had not been inspected by a competent person prior to being used. Components that were not part of the system were being used in conjunction with the integral components compromising the structural integrity of the working level.  Violation was observed on or about March 15, 2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) Worksite was located at 180 Brighton Avenue, Long Branch, NJ 07740  A worker was exposed to fall hazards of approximately twelve to fifteen feet to concrete as he stood on the awning roof of the condominium while working on Azek trim and frieze board  without fall protection on.  Violation was observed on or about March 15, 2023.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1926.1053(b)(5)(i):Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):  a) Worksite was located at 180 Brighton Avenue, Long Branch, NJ 07740  Two workers were exposed to fall hazards as they were doing siding work from two extension ladders that were set up to heights of approximately ten to 15 feet with their bases set out more than four feet from where the ladders were landed.
