29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) Worksite was located at 305 Second Avenue, Avon By The Sea, NJ 07717:  Five workers were exposed to fall hazards of approximately fifteen feet to ground as they were doing siding and trim work on the roof of a newly renovated, two-story single-family house while not utilizing fall protection.  Violation was observed on or about January 22, 2026.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.   FDR Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1745773, citation number 1, item number 1 and was affirmed as a final order on 9/17/2024, with respect to a workplace located at 14 Inlet Terrace, Belmar, NJ 07719.  FDR Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1726208, citation number 1, item number 1 and was affirmed as a final order on 5/29/2024, with respect to a workplace located at 119 Spier Avenue, Allenhurst, NJ 07711.  FDR Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1656820, citation number 1, item number 5 and was affirmed as a final order on 10/5/2023, with respect to a workplace located at 180 Brighton Avenue, Long Branch, NJ 07740.
