29 CFR 1926.451(b)(5)(ii): The end of a platform greater than 10 feet in length extended over its support more than 18 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilivered end:  a- 107 Union Avenue, Spring Lake NJ - A worker was exposed to fall hazards, in excess of 10 feet 7 inches to the ground surface below, when performing siding installation and other related activities from a pump jack scaffold's walking and working surface that extended in excess of 5 feet 6 inches beyond/over the pump jack scaffold's support. Condition observed on or about 03/23/26.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(e)(8): Direct access to or from another surface was used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface:   a- 107 Union Avenue, Spring Lake NJ - A worker was exposed to fall hazards, in excess of 10 feet 5 inches to the ground surface below, when accessing a residential   structure's first floor, unprotected window opening from a pump jack scaffold's elevated walking and working surface that was approximately 28 inches away horizontally.   Condition observed on or about 03/23/26.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms.  a- 107 Union Avenue, Spring Lake NJ - Workers were exposed to fall hazards, in excess of 10 feet 5 inches to the ground surface below, when performing siding installation and other related activities from two pump jack scaffolds whose connected walking and working surfaces were missing end stops and a mid rail/screen running along the scaffold's open sides and ends.  Condition observed on or about 03/23/26.   FDR Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1656820, citation number 1, item number 4 and was affirmed as a final order on October 5, 2023, with respect to a workplace located at 180 Brighton Avenue, Long Branch NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- 107 Union Avenue, Spring Lake NJ - A worker was exposed to fall hazards, in excess of 7 feet 5 inches to the ground surface below, when standing in a residential structure's first floor, unprotected window opening without fall protection.  Condition observed on or about 03/23/26.   b- 107 Union Avenue, Spring Lake NJ - A worker, without fall protection, was exposed to fall hazards, in excess of 9 feet 8 inches to the ground surface below, when standing in a residential structure's first floor, unprotected window opening after using this window opening as an exit point from a pump jack scaffold's elevated walking and working surface.   Condition observed on or about 03/23/26.  FDR Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1745773, citation number 1, item number 1 and was affirmed as a final order on September 17, 2024, with respect to a workplace located at 14 Inlet Terrace, Belmar NJ.  FDR Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1726208, citation number 1, item number 1 and was affirmed as a final order on May 5, 2024, with respect to a workplace located at 119 Spier Avenue, Allenhurst NJ.  FDR Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1656820, citation number 1, item number 5 and was affirmed as a final order on October 5, 2023, with respect to a workplace located at 180 Brighton Avenue, Long Branch NJ.
