One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. a. On or about May 1, 2023, the employer failed to ensure operator(s) of the Line 2 Fill Line, located in the Fill Room, were protected by one or more methods of machine guarding from the rotating parts of the screw auger of the valve placer and the rotating parts of the screw auger of the valve seater. b. On or about May 1, 2023, the employer failed to ensure operator(s) of the Line 3 Fill Line, located in the Fill Room, were protected by one or more methods of machine guarding from the point of operation and rotating parts of the filler machine, rotating parts of the screw auger of the valve placer, rotating parts of the screw auger of the valve seater, and rotating parts of the crimper machine screw auger. c. On or about May 1, 2023, the employer failed to ensure operator(s) of the Line 4 Fill Line, located in the Fill Room, were protected by one or more methods of machine from the point of operation and rotating parts of the filler machine.

Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: On or about May 11, 2023, the employer did not ensure containers used to dispose of aerosol cans filled with hazardous chemicals and/or containers (buckets) used to contain leaks from fill room filing line equipment that contained hazardous chemicals were labeled, tagged, or otherwise marked. Employees fill aerosol cans in the filling room that contain hazardous chemicals that were flammable, gases under pressure, irritants, sensitizers, and/or toxicity hazards.
