29 CFR  1910.119(n): The employer did not establish and implement an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38:  a) 1323 Conshohocken Rd. Plymouth Meeting, PA - On or about January 22, 2024 the employer did not establish and implement an emergency action plan in accordance with the provisions of 29 CFR 1910.38 for handling small releases. Failure to develop and implement these procedures exposes employees to hazards associated with the uncontrolled release of flammable liquids and gases.   b) 1323 Conshohocken Rd. Plymouth Meeting, PA - On or about January 22, 2024, the employer's emergency action plan did not establish and implement procedures to be followed by employees who remain to operate critical plant operations before they evacuate. Failure to develop and implement these procedures exposes employees to fire and explosion hazards associated with the uncontrolled release of flammable liquids and gases.

29 CFR  1910.132(a): Protective equipment was not used, when necessary, whenever hazards capable of causing injury and impairment were encountered:  a) 1323 Conshohocken Rd. Plymouth Meeting - On or about January 22, 2024, employees working in and around the tank farm were not wearing fire resistant clothing when exposed to flash fire hazards. The tanks, piping and equipment in the tank farm contain flammable gases and liquids.   b) 1323 Conshohocken Rd. Plymouth Meeting - On or about January 22, 2024, employees were not required to wear adequate respiratory protection, such as but not limited to SCBA, while responding to a flash fire in the tank farm.   c) 1323 Conshohocken Rd. Plymouth Meeting - On or about January 22, 2024, employees working in the tank farm were not wearing the required footwear when exposed to flash fire hazards.

29 CFR  1910.178(c)(2)(iv): Power-operated industrial trucks designated as DY, EE, or EX were not used in locations where volatile flammable liquids or flammable gases were handled, processed or used, but in which the hazardous liquids, vapors or gases would normally be confined within closed containers or closed systems from which they could escape only in case of accidental rupture or breakdown of such containers or systems, or in the case of abnormal operation of equipment; also in locations in which hazardous concentrations of gases or vapors are normally prevented by positive mechanical ventilation but which might become hazardous through failure or abnormal operation of the ventilating equipment; or in locations which are adjacent to Class I, Division 1 locations, and to which hazardous concentrations of gases or vapors might occasionally be communicated unless such communication is prevented by adequate positive-pressure ventilation from a source of clear air, and effective safeguards against ventilation failure are provided:   a) 1323 Conshohocken Rd. Tank Farm - On or about January 22, 2024, and times prior to, propane-powered LP industrial trucks were used in and around the tank farm, gas house, and batch room B. The employer has classified these areas as Class 1 Division 1, therefore the powered industrial trucks used should be designated as DY, EE, or EX.
