29 CFR  1910.106(e)(2)(iv)(d):Flammable liquids shall be drawn from or transferred into vessels, containers, or portable tanks within a building only through a closed piping system, from safety cans, by means of a device drawing through the top, or from a container or portable tanks by gravity through an approved self-closing valve. Transferring by means of air pressure on the container or portable tanks shall be prohibited.  On or about November 28, 2023, the employer did not ensure the closed piping system used to transfer flammable liquids, such as ExxonMobil, EXXSOL Heptane Fluid, from the Batching Room L1 Batching Tank to portable tanks was equipped with a self-closing valve.

On or about November 28, 2023, the employer did not provide an appropriate half-face respirator with filter(s) for organic vapor for employees working in the Batching Room as Batching/Chemical Operators tasked with cleaning up a chemical spill (release) of ExxonMobil, EXXSOL Heptane Fluid.  Three employees were tasked with cleaning up the chemical spill, one wore an N95 filtering facepiece type respirator, two employees did not utilize any type of respirator.

The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about November 28, 2023, the employer did not provide a medical evaluation to determine a Batching Room Chemical Operator's ability to use a respirator before being tasked with cleaning up a chemical spill (release) of ExxonMobil, EXXSOL Heptane Fluid while wearing a N95 filtering face piece type respirator.

Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about November 28, 2023, the employer did not ensure an employee working in the Batching Room as Chemical Operator was provided with information and training on hazardous chemicals in their work area at the time of their initial assignment.  Employees working in the Batching Room work with chemicals and are tasked with cleaning up chemical spills, such as ExxonMobil, EXXSOL Heptane Fluid.
