29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a - 41 & 43 Payne Avenue, Lakewood NJ: While engaged in framing and other related activities the company worksite Foreman was exposed to fall hazards, up to and in excess of 23 feet to the ground surface below, when walking on and working from the top of pitched roof trusses while wearing a full body harness that was improperly attached to a point that was not qualified as an anchor. Condition noted on or about 05/02/23. b - 41 & 43 Payne Avenue, Lakewood NJ: While engaged in framing and other related activities the company worksite Foreman and a worker were exposed to fall hazards, up to and in excess of 10 feet to the flooring below when walking and working from the structure's center eye beam while wearing full body harnesses that were improperly attached to points that were not qualified as anchors. Condition noted on or about 05/02/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a - 41 & 43 Payne Avenue, Lakewood NJ: While engaged in framing and other related activities the company worksite Foreman and a worker were exposed to fall hazards up to and in excess of 23 feet to the ground surface below when they were improperly utilizing fall protection equipment at the worksite. was exposed to fall hazards, up to and in excess of 23 feet to the ground surface below, when walking on and working from the top of pitched roof trusses while wearing a full body harness that was improperly attached to a point that was not qualified as an anchor. Through statements provided to the CSHO, the company worksite workers and Foreman had not received fall protection training from the company in the area specified in 29 CFR 1926.503 (a)(2)(i) through (viii). Condition noted on or about 05/02/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
