29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. At an establishment located at 3312 Lakeshore Drive, in Sheboygan, Wisconsin; (a) During the week of April 10, 2023, in Bay 6, the guarding installed did not prevent access between the fence and CMH016 molder while in operation exposing employees to struck by and caught between hazards. (b) During the week of May 1, 2023, in Bay 7, the guarding installed did not prevent access between the fence and CMH015 molder while in operation exposing employees to struck by and caught between hazards. (c) On or about April 24, 2023, in Bay 15, the guarding installed did not prevent access between the fence and CMH007 molder while in operation exposing employees to struck by and caught between hazards. (d) During the week of May 3, 2023, in Bay 17, the guarding installed did not prevent access between the fence and CMH012 molder while in operation exposing employees to struck by and caught between hazards. (e) On or about May 3, 2023, in Bay 19, the guarding installed did not prevent access between the fence and CMH014 molder while in operation exposing employees to struck by and caught between hazards. (f) On or about April 10, 2023 and prior to, in Bay 36, the area scanner installed between the fence opening and molder did not prevent access while in operation exposing employees to struck by and caught between hazards.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about May 3, 2023, at an establishment located at 3312 Lakeshore Drive, in Sheboygan, Wisconsin; in Bay 19, while the employee(s) removed excess slag, cleaned out the mold, and applied a release on the C.H.M Mfg Co, Mfgr of Hall, Permanent Mold Machines CMH014 there was no point of operation guarding. During the operation, the employee was not in visible sight of the two hand controls located on the main control panel and the access door with key system only de-energized the robots in the cell exposing employees to caught between hazards.

29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed. At an establishment located at 3312 Lakeshore Drive, in Sheboygan, Wisconsin; the employer did not conduct periodic inspections of the energy control procedures to ensure an accurate procedure and employees were familiar with their responsibilities under the procedures. Watry Industries, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1551613, citation number 1, item number 1a and was affirmed as a final order on January 19, 2022, with respect to a workplace located at 3312 Lakeshore Drive, in Sheboygan, Wisconsin.

29 CFR 1910.147(c)(5)(ii): Lockout devices and tagout devices shall be singularly identified; shall be the only devices(s) used for controlling energy; shall not be used for other purposes; and shall meet the following requirements: On or about May 3, 2023, at an establishment located at 3312 Lakeshore Drive, in Sheboygan, Wisconsin; in Bay 14, the service door providing entry into the robotic cell was chained and locked utilizing a lock out device to prevent employees from entering. The lock out device was being used for purposes other than the control of hazardous energy.
