29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Everardo Servin LLC, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 1 a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of October 5, 2023.  Citation 1, Item 2 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of October 5, 2023.  Citation 1, Item 3 a serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of October 5, 2023.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

(a) On or about June 21, 2023, at 851 South Wilson Street Hartford, WI 53027, frequent and regular job site inspections were not conducted to identify and correct safety hazards, including but not limited to fall hazards.

(a) On or about June 21, 2023, located at 851 South Wilson Street Hartford, WI 53027, employees conducting roofing work on an existing residential home without fall protection had not received fall protection training.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about June 21, 2023, located at 851 South Wilson Street Hartford, WI 53027, employees conducting roofing work on an existing residential home were utilizing ladders at the front side and the back side of the home that did not extend at least three feet (.9 meter) above the upper landing surface being accessed.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about June 21, 2023, located at 851 South Wilson Street Hartford, WI 53027, employees conducting roofing work on an existing residential home with an approximately 10:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 19 feet on the right (North) side of the house.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1602630, citation number 1, item number 1 and was affirmed as a final order on August 2nd, 2022, with respect to a workplace located at N1655 Greenwood Road, Greenville, WI 54942.
