29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about September 19, 2024, at a jobsite located at 3747 E Bluestem Dr., OAK CREEK, WI 53154, an employee working on the ground performing cleanup and assisting the roofers who were working directly above roofing the structure, was not protected from struck by hazards from falling materials and tools by wearing a protective helmet.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  (a) On or about September 19, 2024, at a jobsite located at 3747 E Bluestem Dr., OAK CREEK, WI 53154,  a competent person was on site but did not perform frequent and regular inspections of the jobsite to ensure that hazardous conditions were identified and corrected.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2) , which was contained in OSHA inspection number 1678064, citation number 1, item number 1 and was affirmed as a final order on December 12, 2023, with respect to a workplace located at 851 South Wilson Street, Hartford, WI 53027.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about September 19, 2024, at a jobsite located at 3747 E Bluestem Dr., OAK CREEK, WI 53154, employees conducting roofing activities (shingle installation) on a 18:12 pitch roof of the residential structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the roof of the structure of approximately 10.3 feet.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1678064, citation number 2, item number 1 and was affirmed as a final order on December 12, 2023, with respect to a workplace located at 851 South Wilson Street, Hartford, WI 53027.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1602630, citation number 1, item number 1 and was affirmed as a final order on August 2, 2022, with respect to a workplace located at N1655 Greenwood Road, Greenville, WI 54942.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about September 19, 2024, at a jobsite located at 3747 E Bluestem Dr., Oak Creek, WI 53154, the employer did not ensure that employees exposed to potential fall hazards of 10.3 feet or greater  while working from an 18:12 pitch roof had been properly trained to recognize, minimize, or eliminate the fall hazards associated with this work. This exposed employees to a fall hazard onto grass, building materials, and concrete.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1678064, citation number 1, item number 2 and was affirmed as a final order on December 12, 2023, with respect to a workplace located at 851 South Wilson Street, Hartford, WI 53027.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about September 19, 2024, at a jobsite located at 3747 E Bluestem Dr., Oak Creek, WI 53154,  the portable ladder being used by employees to access the roof of the structure at or near the garage door did not extend at least three (3) feet above the upper point of contact with the eave, nor was it secured in place. This exposed employees accessing and egressing the roof, to a fall hazard of approximately 11.3 feet onto grass, building materials, and  concrete.
